- Andrew's e-Discovery Comments: I first encountered e-discovery issues during my clerkship with Judge Johnson. Our civil caseload revolved around discovery disputes and the Judge was not shy about bringing the parties in for a hearing to find some common ground. Of course, nowadays every case is an e-discovery case and I’ve worked on some notable ones, including a case that resulted in a published opinion about shifting e-discovery costs based on proportionality. With the technology that’s out there, my hope is that attorneys and clients of every stripe can spend more time on the merits of a case, and less time bogged down in the e-discovery weeds.
